Court adjourns to June 1 case between Asanko Mines & laid-off workers

Court adjourns to June 1 case bThe legal battle between Canadian-based Galiano Gold’s Asanko Gold Ghana Limited and the Ghana Mine Workers Union (GMWU) over what the plaintiff describes as the Mines’ decision to lay off some 299 permanent staff without payment of appropriate compensation due all affected employees has been adjourned.

The Amasaman High Court in the Greater Accra Region on Thursday, May 19 adjourned the case to Wednesday, June 1 because, according to counsel for the plaintiff, Asanko Gold Ghana claims it had not received any affidavits in opposition from Ghana Mine Workers Union to their motion.

Therefore, the adjournment was to afford them the opportunity to be served.

The two entities are in court over non-adherence to the collective bargaining agreement relating to payment of severance to the Union’s members.

According to the mine workers, their condition of service agreed upon have not been adhered to by the Asanko Gold board, especially, when it comes to the compensation for severance.

The workers claim that Asanko Gold Mine has terminated the permanent employment of 299 staff and has reduced their salaries and made their conditions worse off without payment of severance to affected workers as agreed in the collective bargaining agreement.

The GMWU lamented that after several meetings with management of Asanko Gold Ghana, they still did not see any changes on the need for the company to pay appropriate severance as agreed, hence their decision to resort to the courts.

Counsel for the GMWU further disclosed that Asanko Gold Ghana wanted the case struck out because, according to them, the case was premature.

But the Ghana Mine Workers filed an affidavit, objecting to that motion.

They were supposed to argue that motion Thursday for the court to take its decision.

However, Counsel for Asanko Gold Ghana told the court that the bailiff has not yet served them with the affidavit and so pleaded for an adjournment.

The presiding judge, therefore, obliged and adjourned the case to June 1, 2022.
