Out of shame, the referendum was illegally aborted, now let’s test the law as to whether or not Nana Addo acted ultra vires.

Article 290 of the 1992 constitution listed entrench clauses and processes to amend them.

Article 297 (d) rolled out the process to amend bills with constitutional instruments or writ, like that of article 55(3) which has a constitutional instrument or referendum writ from the electoral commission.

Now, before article 55(3) can be legally aborted, it must take 21 days to go through the reversal processes, the electoral commission must effect a revocation of the referendum writ and lay it before parliament for 21 days to have a legal abortion right, the executive organ of government (president) don’t have the power to illegally abort a bill laid before parliament for 21 days, which has even gone through Gazetted processes at his own will, that is very strange in a democratic society, where rule of law and separation of powers exist.



From December 1st to 17th which was set for the referendum to take place is less than 21 days for the referendum to obtain a legal abortion right as article 297(d) stipulates.

Article 45 and 46 has been breached as well, this is what happens when we have apprenticeship system lawyer as a president.

The electoral commission should payback to the country, monies spent to run adverts and printed materials for the illegally aborted referendum, for negligence of duty.
